Gift Certificates Terms

Each retailer establishes its own policies. Gift certificates feature specific retailer terms and conditions, including expiration date and any cash back policies.

Prepaid Cards

Prepaid cards are fulfilled to the address supplied. Hallmark Business Connections will not be responsible for lost cards as a result of non-delivery due to incorrect or illegible addresses or other occurrences outside of our control. Title and risk of loss shall pass to the purchaser upon deposit in the US Mail or with an express carrier.

Prepaid cards cannot be returned or exchanged without incurring processing fees.

Unredeemed Awards and Expired Certificates

In order to offset the costs and expenses of maintaining unredeemed Premiere Choice Awards on its books and records, Ha llmark Business Connectionsreserves the right to assess a service charge not to exceed $2.00 per month on any Premiere Choice Awards that are not redeemed within 24 months of issuance.

Expired RCC cannot be redeemed or reissued.

Force Majure

Hallmark Business Connections shall not be liable for any delays in the delivery of orders, due in whole or in part, directly or indirectly, to fire, acts of God, strike, shortage of raw materials, supplies or components, retooling, upgrading of technology, delays of carriers, embargo, government order or directive, or any other circumstance beyond Hallmark Business Connections reasonable control. Purchaser agrees that Hallmark Business Connections shall not be liable for any direct, indirect, consequential or special damages which may result from any such delays.

Limitation of Liability

In no event shall Hallmark Business Connections be liable for any indirect, consequential or special damages and in all cases Hallmark Business Connections' liability shall not exceed the purchase price of the Award or Certificate. APPLICABLE LAW: This agreement shall be governed by and construed in accordance with the internal laws (and not the laws of conflicts) of the State of Minnesota. INSPECTION AND ACCEPTANCE: Purchaser must inspect delivered Awards and/or Certificates and report claim for damages or shortages in writing within ten (10) days of delivery or the Awards and/or Certificates shall be deemed irrevocably accepted and such claims shall be deemed waived.

SMS Text Messaging Terms

Hallmark Business Connections customers can opt-in to receive SMS notifications of their order status from Hallmark Business Connections via short code HBC411 (422411).  If customers elect to receive SMS notifications, they are required to opt-in on the activation page at hallmarkbusiness.com.  Message and data rates may apply.  

Those Customers who choose to receive SMS notifications to their mobile phones must review and agree to these additional terms:

• By opting-in, you consent to receiving text messages from us which may include offers from us, our affiliates and partners. You can unsubscribe at any time from the service by sending STOP to 422411. For can receive help at any time from the service by sending HELP to 422411.
• You represent that you are the owner or authorized user of the wireless device you use to subscribe for the service, and that you are authorized to approve the applicable charges.
• We will not be liable for any delays or failures in your receipt of any SMS messages as delivery is subject to effective transmission from your network operator and processing by your mobile device. SMS message services are provided on an AS IS, AS AVAILABLE basis.
• Data obtained from you in connection with this SMS service may include your cell phone number, your carrier’s name, and the date, time and content of your messages and other information that you may provide. We may use this information to contact you and to provide the services you request from us, and to otherwise operate, develop and improve the service. Your wireless carrier and other service providers may also collect data about your SMS usage, and their practices are governed by their own policies.
• The service and the content and materials received through the service are proprietary to us or our licensors, and is for your personal, non-commercial use only.
• You shall not damage, impair, interfere with or disrupt the service or its functionality.
• The service is available only in the United States on the following carriers: AT&T, Alltel Mobile Communications, Inc., Dobson (Cellular One), Cricket Wireless (Leap), Western Wireless, Cincinnati Bell Wireless (CBW), US Cellular, T-Mobile US, Guam Wireless - Hafatel, Guamcel, Midwest Wireless, NTelos, Nextel, Verizon Wireless, and Sprint.
• We reserve the right to alter charges and/or these terms and conditions from time to time. We may suspend or terminate the service to you if we believe you are in breach of our terms and conditions. Your service is also subject to termination in the event that your wireless service terminates or lapses. We may discontinue the service at any time. 

Miscellaneous

If any provision of this Agreement is found to be invalid or unenforceable in any respect, the validity and enforceability of the remaining provisions shall not be affected. All clerical errors are subject to correction. The failure of Hallmark Business Connections to enforce at any time any of the provisions of the Agreement shall not be construed to be a waiver of such provisions nor the right of Hallmark Business Connections to enforce such provisions in the future. Purchaser may not assign any rights under this Agreement without the written consent of Hallmark Business Connections. Purchaser shall have no right to set off amounts due with respect to one transaction for claims under any other transaction with Hallmark Business Connections. Any disputes arising under this Agreement shall be resolved, if not sooner settled, by a state or federal court of competent jurisdiction located in Minneapolis or St. Paul, Minnesota, U.S.A., and the Purchaser hereby irrevocably submits to the exclusive jurisdiction of such courts.
